Arven LLC (“Arven,” “we,” “us,” and “our”) provides an AI-powered fitness coaching application that creates personalized training plans and workouts, tracks your activity, and answers your questions through a chat feature (the “App”). This Privacy Policy explains how we collect, use, and share personal information when you use the App, and the choices and rights available to you. This Privacy Policy is incorporated by reference into our Terms of Service, which govern your use of the App. This Privacy Policy does not apply to the practices of companies that Arven does not own or control.
1. PERSONAL INFORMATION WE COLLECT
The personal information we collect depends on how you use the App.
A. Information You Provide to Us
Account Information. When you create an account, we collect your name and email address. We currently use a password free login, sending a one-time code to your email address to verify your identity; if we offer password-based login in the future, we will also collect a password.
Fitness and Health Information. To build and personalize your training plan, we collect information you provide such as your age, sex, height, weight, body measurements (e.g., chest, waist), training goals, training history, available equipment and schedule, and workout results and check-ins. If you choose to share them, we also collect any medical conditions, injuries, or physical limitations you voluntarily disclose. We use this information solely to tailor your training plan and coaching — it is not used, and is not intended, to diagnose, treat, or evaluate any medical condition. See Section 3 (“Health and Fitness Disclaimer; Assumption of Risk”) of our Terms of Service.
Chat Messages and Voice Recordings. We collect the notes and chat messages you send through the App's chat feature, and, if you choose to use it, voice recordings that are transcribed into text. We do not retain the raw audio of voice recordings after they are transcribed.
Payment Information. If you subscribe to the App, our payment processors (Stripe for web subscriptions, and Apple or Google for in-app purchases) collect and process your payment information. We do not directly collect or store your full payment card information.
Communications. If you contact us for support or otherwise communicate with us, we collect your name, email address, and the content of your communications.
B. Information Collected Automatically
Usage and Device Information. We automatically collect certain information when you use the App, such as your device type, operating system, app version, general usage activity, timezone, and crash or error logs. We do not collect your precise or approximate location.
Health App and Wearable Data. The App does not currently connect to Apple Health, Google Fit/Health Connect, or other wearables. If we add this functionality, it will be optional, and we will collect only the categories of data (such as workouts or heart rate) that you affirmatively choose to share, in accordance with Apple's and Google's respective developer guidelines.
Analytics. We use PostHog to understand how users interact with the App so that we can improve it, and Sentry to detect and diagnose errors.
C. Information from Other Sources
If you sign up or log in through a third-party service (such as an app store account), we may receive information about you from that service in accordance with your privacy settings with that service.
2. COOKIES AND SIMILAR TECHNOLOGIES
When you visit our website (for example, to sign up or manage your subscription) or use the App, we and our service providers may use cookies, mobile device identifiers, and similar technologies (“Cookies”) to operate our services, remember your preferences, and understand how our website and App are used.
Types of Cookies We Use. We use Cookies that are necessary for our website and Stripe's subscription checkout to function, and Cookies used by PostHog to understand how our website and App are used so that we can improve them. We do not use Cookies for third-party or interest-based advertising, and we do not permit third parties to use Cookies on our website or App to track you across other companies' websites or apps.
Embedded Content. Where the App embeds YouTube videos, YouTube may set its own cookies or use similar technologies in accordance with its own privacy practices, as described in Section 4 below.
Your Choices. You can control or delete Cookies through your browser settings. Blocking certain Cookies may affect the functionality of our website, including the ability to complete a subscription checkout. When you use our mobile application, we primarily rely on the analytics and device information described in Section 1(B) above rather than browser Cookies; if you use the App through a web browser, the Cookies described above may also apply. Our website does not currently respond to “Do Not Track” browser signals.
3. HOW WE USE YOUR INFORMATION
We use your personal information to:
- Provide, operate, and maintain the App, including generating your personalized training plans, tracking your progress, and powering the chat feature;
- Communicate with you about your account, respond to support requests, and send you service-related notices (such as changes to this Privacy Policy or our Terms);
- Process subscription payments and manage billing;
- Monitor, maintain, and improve the App's performance and security, including diagnosing errors; and
- Comply with our legal obligations and enforce our agreements.
We will not use or disclose your health or fitness information for advertising, marketing, or other data-mining purposes unrelated to providing the App, and we do not sell your personal information. We will not collect additional categories of personal information, or use the personal information we have collected for materially different, unrelated, or incompatible purposes, without providing you notice or, where required, obtaining your consent.
4. HOW WE SHARE YOUR INFORMATION
We do not sell your personal information. We share personal information only as described below.
A. AI Coaching Providers
To generate your personalized training plans, answer your questions in the chat feature, and provide workout feedback, we share relevant profile, health, fitness, workout, and chat information with our artificial intelligence providers that power these features. If you use the voice-to-text feature, your voice recording is shared with one of these providers for transcription only; we do not retain the raw audio afterward. These providers process this information on our behalf, under their own data protection terms, to generate the outputs the App provides to you. Under our agreements with our artificial intelligence providers, they do not use the information we submit through their APIs to train their models.
B. Service Providers
We share personal information with third-party service providers who perform services on our behalf, including:
- Supabase and Amazon Web Services — database hosting and storage;
- Vercel — application hosting;
- Stripe — web subscription billing;
- RevenueCat and Expo — in-app subscription billing and push notifications on mobile (once implemented);
- PostHog — product analytics;
- Sentry — error monitoring; and
- Customer support and email/marketing platforms we may adopt in the future (for example, Intercom or Customer.io), if and when we begin using them.
The App also embeds YouTube videos and may use browser or mobile push-notification services; your interactions with those embedded features are subject to the relevant provider's own privacy practices.
C. Other Disclosures
We may also disclose personal information (i) to comply with a legal obligation, such as a subpoena or court order; (ii) to protect the rights, property, or safety of Arven, our users, or others; or (iii) in connection with a merger, acquisition, financing, or sale of some or all of our assets, in which case personal information may be transferred as part of that transaction.
5. AGGREGATED AND DE-IDENTIFIED DATA
We may create aggregated, de-identified, or anonymized data from the personal information we collect, including by removing information that makes the data identifiable to a particular user. We may use and disclose such aggregated, de-identified, or anonymized data for our lawful business purposes, including to analyze usage, operate and improve the App, and understand outcomes across users, provided that we will not attempt to re-identify it or disclose it in a way that could identify you.
6. YOUR PRIVACY CHOICES AND RIGHTS
- Access, Correct, or Update Your Information. You can review and update most of your profile information directly in the App, or by contacting us.
- Delete Your Account. You may request deletion of your account and associated personal information at any time by contacting us at the email address below. We will delete your information except where we are required or permitted to retain it (for example, to comply with law or resolve disputes).
- Communications. You may opt out of non-essential email communications using the unsubscribe link in those emails. You will continue to receive service-related communications necessary to operate your account and subscription.
- Additional Rights. Depending on your state or country of residence, you may have additional rights, such as the right to know what categories of personal information we have collected about you, the right to request a copy of it, or the right to object to certain processing. California residents should also see Section 10 below. To exercise any of these rights, contact us as set forth in Section 12 below.
7. SECURITY
We treat your health, fitness, and other personal information as sensitive and use administrative, technical, and physical safeguards designed to reduce the risk of unauthorized access, use, disclosure, or loss, such as encryption, access controls, and monitoring appropriate to the information involved. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Security Incidents. If we learn of a security incident affecting your personal information, we will investigate and notify you and any applicable regulator as required by law. Because we collect health and fitness information, a security incident may also trigger notice obligations under the FTC's Health Breach Notification Rule, in addition to state breach-notification laws and the CCPA.
8. INTERNATIONAL DATA TRANSFERS
We are based in the United States, and our service providers store and process information in the United States. If you access the App from outside the United States, your information will be transferred to, stored, and processed in the United States, which may have data protection laws that are different from those of your country of residence.
9. DATA RETENTION
We retain personal information for as long as necessary for the purpose for which it was collected, as described below, and thereafter for as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
- Voice recordings. Deleted after transcription, as described in Section 1 above, subject to any legally required backups.
- Account and subscription records. Retained while your account is active and for the period reasonably needed for billing, tax, and fraud-prevention purposes afterward.
- Fitness, health, and chat information. Retained while your account is active and used to provide the App, until you request deletion under Section 6 above.
- Analytics and error logs. Retained according to the configured retention periods of the applicable tool (currently PostHog and Sentry).
10. SUPPLEMENTAL NOTICE FOR CALIFORNIA RESIDENTS
This section applies to California residents and supplements the rest of this Privacy Policy, as required by the California Consumer Privacy Act, as amended (“CCPA”).
Categories of Personal Information. In the past 12 months, we have collected the categories of personal information described in Section 1 above, which include identifiers (such as your name and email address), health and fitness information you provide (including any voluntarily disclosed medical conditions, injuries, or limitations), commercial information (such as your subscription and billing history), audio information (voice recordings, prior to transcription), and internet or other electronic network activity information (such as app usage and device data). Health and fitness information you provide is treated as sensitive personal information under the CCPA.
How We Use and Disclose It. We use and disclose these categories of personal information for the purposes described in Sections 3 and 4 above — principally, to provide and improve the App, including generating your training plans and chat responses through our AI providers, to process payments, and to communicate with you. We use sensitive personal information (your health and fitness information) only to provide the App's core coaching functionality, and not to infer characteristics about you or for any other secondary purpose.
No Sale or Sharing. We do not sell personal information, and we do not share personal information for cross-context behavioral advertising, as those terms are defined under the CCPA.
Your California Rights. Subject to certain exceptions, California residents have the right to: (i) know what personal information we have collected, used, disclosed, and (if applicable) sold about them; (ii) request deletion of their personal information; (iii) request correction of inaccurate personal information; (iv) limit the use of sensitive personal information to purposes permitted under the CCPA (which, as described above, is already how we use it); and (v) not receive discriminatory treatment for exercising any of these rights. You may designate an authorized agent to make a request on your behalf.
How to Exercise Your Rights. To exercise any of these rights, contact us at support@arvenapp.com. We will take reasonable steps to verify your identity before responding, which may require you to confirm information associated with your account.
11. CHILDREN'S PRIVACY
The App is not directed to, and is not intended for use by, anyone under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will delete it.
12. CHANGES TO THIS PRIVACY POLICY; CONTACT US
We may update this Privacy Policy from time to time. If we make material changes, we will notify you as required by applicable law. Your continued use of the App after an updated Privacy Policy takes effect constitutes your acceptance of the changes.
